Affiliate Program Terms
Please read these Terms carefully before applying to become an Affiliate in the zagomail Affiliate Program. These Terms are meant to provide a foundational understanding of our Affiliate Program and its operation. Throughout these Terms, references to “we,” “us,” and “our” mean zagomail, whereas references to “you,” “your,” and “yours” to the Affiliate. Your participation as an Affiliate in the zagomail Affiliate Program is dependent upon your acceptance of the following terms and conditions.
1. Affiliate Rights and Obligations
1.1. To apply for Affiliate membership, please fill up and submit the application form found here. You will need to provide your real name, email address, and other personal details throughout the register process.
However, your login is for your alone use; sharing your login with others is not allowed and will result in suspension of all accounts. You will be given a special Affiliate Code when you join up for the Affiliate Program. You can use your Affiliate Code in links, banners, and other visuals on your site, in emails, and in other communications. We’ll provide you with unique link formats to use in all connections between your site and the zagomail site so that tracking, reporting, and referral fee accrual can happen accurately.
Furthermore, It is your responsibility to guarantee that all of the links on your site leading to the zagomail site use the correct structure for such unique connections. Any links to the zagomail website that are correctly formatted using such special link formats and are included on your website in accordance with these rules are collectively referred to as “Special Links.” You are only eligible to receive referral fees with regard to sign-ups on Zagomail product sites that take place directly as a result of Special Links.
1.2. We do not accept sites that promote illegal activities, violence, discrimination on the basis of any ground, include any materials that infringe or assist others to infringe on any copyright, trademark or other intellectual property rights, or to violate the law, or that are otherwise unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically, or otherwise objectionable to us. We are not obligated to accept any Affiliate application and have the right to do so at our own discretion;
1.3. It is strictly prohibited for you to construct or design your website, social network profile, or any other profile in a way that mimics zagomail’s website or that misleads consumers into believing that you are zagomail;
1.4. As a participant in the Zagomail Affiliate Program, you will be granted access to the Affiliate account and Dashboard. From there, you will be able to track the signups and purchases made by your referrals, as well as the payments that are subsequently sent to you;
1.5. zagomail retains the right, in its sole discretion and at any time, to evaluate your placement and demand that you update it or use it in a manner that is in accordance with the criteria that have been given;
1.6. By participating in the zagomail Affiliate Program, Affiliate acknowledges and agrees that it is not entering into a partnership, joint venture, franchise, sales representative, or employment relationship with zagomail. It is expressly understood that you are not authorized to make or accept any offers or representations on our behalf.
1.7. You must not make any claims on your website that might be seen as going against the terms of this clause.
1.8. Your account information, including your password, is entirely within your control. If you fail to meet this security requirement, zagomail will not be responsible for any resulting loss or harm.
1.9. The Affiliate Program cannot be used in violation of the law or without the express permission of the Affiliate Program’s administrator. You must abide by all local regulations.
2. Zagomail Rights and Obligations
2.1. We reserve the right to check in at any moment on your website or social media to make sure you’re complying with the terms and conditions outlined above;
2.2. If you misuse the Zagomail Affiliate Program in any manner, zagomail has the right to immediately cancel your membership;
2.3. If you or someone you recommend does not utilize Special Links or enters the wrong Affiliate Code, zagomail is not responsible and will not make any adjustments to the sums owed to you under the Affiliate Program.
3. Affiliate Dashboard
We’ll provide you access to an Affiliate Dashboard where you can keep tabs on how many people you’ve referred, what they’ve bought, and how much money you’ve made from it. You will also be provided with the necessary promotional materials to promote and sell Zagomail.
4. Payments and Refunds
4.1. You will get 30% of the original selling price of the monthly or yearly plan. One time offers are excluded, you will be paid commissions only for monthly recurring subscription. To be credited with a referral sale, the customer must follow a Special Link you provided on your site, email, or other communications to the zagomail Site and complete the purchase there. After 30 days of their initial visit, the people you suggest must join up for zagomail using your affiliate link. After 30 days, you won’t get a cut of any purchases they make on zagomail.
4.2. It is possible to earn a commission as a referral fee. The current rate of commission is 30% of all proceeds. After you hit 5 sales and $100 in earnings, you can request payment. Only links that are automatically monitored and reported by our systems will result in a commission payment. If a user claims to have joined up or input a referral code but their actions were not recorded, we will not reward them with a commission. Only sales made via properly structured unique links that our systems were able to automatically trace would result in a commission payment. Commissions obtained by deceptive, unlawful, or otherwise dubious sales or marketing practices are subject to disqualification.
4.3. For you to be eligible for affiliate commissions, the person you suggest to Zagomail must first make a purchase from inside the Zagomail app, either with a credit card or a PayPal account.
4.4. You can only receive commissions via PayPal at this time. We are unable to send you a check, cash, or credit your account. For payouts, you’ll need a PayPal account. You are free to get a PayPal account whenever you choose, but you won’t be paid until you do.
4.5. Any outstanding affiliate earnings exceeding $100 will be paid out within 50 days of a claim being submitted. In certain cases, you’ll need to manually send the invoice to seek payment. The payment will be held until we get the correct invoice.
4.6. You are responsible for paying any payment processing costs that may be incurred as a result of using our payment processor to receive commission payments.
4.7. If you are permanently prohibited for violating these Rules, you will not get any compensation for any referral purchases made before or after your suspension. Instantly, we will be putting a halt to any further payments. If you are abusing our Affiliate Program, we also do not issue refunds.
5. Termination and Modification
5.1. In order to terminate this Affiliate Program, either you or we must provide writing notice to the other party. Any and all notices must be sent through email.
5.2. We retain the right to cancel your participation in the zagomail Affiliate Program at any time should you fail to comply with the terms and conditions set out in this agreement. We will make every effort to reach out to the Affiliate in advance of the suspension. If a participant in our Affiliate Program engages in any of the banned activities even once, we retain the right to immediately and permanently terminate their participation in the program.
5.3 We reserve the right, at any time and without prior notice, to change any of the terms and conditions set out herein. You will get an email notification if this occurs. The Affiliate Program might be terminated if any changes made are not acceptable. If you continue to use the Zagomail Affiliate Program after these changes have been made, you will be considered to have agreed to them. If we detect any fraud we reserve the right to ban your account without prior notice.
6. Limitation on Promotion
6.1. Sending “spam” or unsolicited commercial emails is against our policy and might be detrimental to our brand. You are allowed to send emails to your users to promote Zagomail so long as the receiver is a client or subscriber of your services or website, and so long as the recipient is given the choice to opt out of receiving emails from you and your website. You must always make it obvious that you’re not affiliated with zagomail. The zagomail Affiliate Program is subject to quick termination should it come to our knowledge that you are marketing us in an inappropriate manner.
6.2. AdWords affiliates that use the terms “zagomail,” “zagomail.com,” “www.zagomail,” “www.zagomail.com,” or “similar” or “misspelled” variations of these terms in their ad copy will be terminated from the Zagomail Affiliate Program for trademark infringement.
6.3. Affiliate shall not use any online advertising services (i.e. Google AdWords, Bing Ads, etc.) to promote zagomail or act on our behalf, nor shall Affiliate use any technologies to abuse our Affiliate Program, including, but not limited to, an application that causes the overwriting of affiliate commission tracking cookies; intercepts searches to redirect traffic through an installed software; sets commission tracking cookies through loading of zagomail site in iFrames, hidden links, and a cookie stuffing script
6.4. Affiliates are not permitted to use affiliate links (such as zagomail.com/?via) that send users directly to the www.zagomail.com domain or any subpages or subdomains.
7. Limitations of Liability
7.1. NO MATTER THE BASIS OF THE CLAIM (CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR OTHERWISE), WE WILL NOT BE RESPONSIBLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE OR GOODWILL OR ANTICIPATED PROFITS OR LOST BUSINESS) ARISING OUT OF OR IN CONNECTION WITH ANY SUBJECT MATTER OF THIS AGREEMENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THIS AGREEMENT, ZAGOMAIL’S TOTAL LIABILITY TO YOU ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER IN CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY, SHALL IN NO EVENT EXCEED THE TOTAL COMMISSION FEES PAID TO YOU UNDER THIS AGREEMENT
